Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your access to and use of the Lumen platform operated by Lumen Labs ("Lumen," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

2. Account

You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Subscription & Billing

Paid plans are billed monthly or annually in advance. Fees are non-refundable except as required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period.

4. Acceptable Use

You agree not to:

• Use the Service to violate any law or third-party right.
• Reverse-engineer, decompile, or attempt to extract source code.
• Send spam, malware, or unsolicited communications.
• Interfere with the integrity or performance of the Service.
• Use the Service to build a competing product.

5. Customer Content

You retain all rights to data and content you submit to the Service. You grant Lumen a limited license to host, process, and transmit your content solely to provide the Service. We will not access your content except as required to deliver support, comply with legal obligations, or prevent fraud.

6. Intellectual Property

The Service, including all software, designs, and documentation, is owned by Lumen and protected by intellectual-property laws. No license is granted except for limited rights to use the Service in accordance with these Terms.

7. Confidentiality

Each party agrees to protect the other's confidential information using the same standard of care it uses for its own confidential information, and at minimum a reasonable standard of care.

8. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Lumen's aggregate liability under these Terms is limited to the fees paid by you in the twelve months preceding the claim. Lumen is not liable for indirect, incidental, special, or consequential damages.

10. Indemnification

You agree to indemnify and hold Lumen harmless from any claim arising out of your misuse of the Service or breach of these Terms.

11. Termination

We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately and we will delete your customer content within 30 days, unless retention is required by law.

12. Governing Law

These Terms are governed by the laws of Belgium, excluding its conflict-of-laws rules. Disputes will be resolved in the competent courts of Brussels.

13. Changes

We may update these Terms periodically. Material changes will be communicated with at least 30 days' notice before taking effect.
